Titanium Dioxide – Carcinogenic Classification
Titanium Dioxide, classification annulled in the Court of Justice of the European Union in relation to Commission Delegated Regulation (EU) 2020/2017.
The Court annuls the aforementioned Commission Delegated Regulation of 2019 as regards the harmonized classification and labeling of Titanium Dioxide as an inhalation carcinogen in certain powder forms.
This Delegated Regulation modifies, for the purposes of its adaptation to technical and scientific progress, Regulation (EC) No. 1272/2008 of the European Parliament and of the Council, on the classification, labeling and packaging of substances and mixtures, and corrects said Regulation .
The Court notes that the Commission made a manifest error in its assessment of the reliability and acceptability of the study on which the classification was based. Likewise, it infringed the criterion according to which the classification of a substance as carcinogenic can only be applied to a substance that has the intrinsic property of causing cancer.
